We process your data only as necessary for the purpose of providing a functional and user-friendly website and app and for the provision of our content and services. San Francisco, CA 94105, USA), a customer relationship management system (CRM), to manage and maintain our customer relationships. When using Salesforce, we process the following categories of personal data:

  • - Contact data: e.g. name, address, e-mail address, telephone number.
    - Communication data: e.g. content of emails, conversation notes.
    - Contract data: e.g. contract number, contract content, service data.
    - Interaction data: e.g. information about the use of our products or services.

We use Salesforce for the purpose of managing our customer relationships and communication as well as processing inquiries and orders and, if necessary, for analyzing and improving our services. The legal basis for the processing is consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR, provided that you have transmitted your data to us for the purpose of contacting us, as well as for the implementation of pre-contractual measures and fulfillment of contracts pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR.

4. registration

No registration is required to use the app. However, to use the Services, in particular to order goods in the App, you must create a customer account ("User Account") by following the registration instructions in the App. When registering for a User Account, you must provide a password and submit to foodji certain personal data, such as name, address, email address, mobile phone number, and - unless it is a free order (e.g., as part of a promo with a coupon code) - at least one valid payment method, which we need for the purpose of processing your order. We process the data of our customers to enable them to select, purchase or order the selected products, goods and related services, as well as their payment and delivery, or execution. The mandatory data required for the processing of contracts are marked separately, other data are voluntary. In this respect, we process, for example, inventory data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contact data (e.g. e-mail, telephone numbers); contract data (e.g. subject matter of the contract, term, customer category). The processing of customer data is carried out for the fulfillment of contracts concluded via the app on the legal basis of Art. 6 para. 1 p. 1 lit. b DSGVO.

Social Media Login

For the registration and login to the user account, you also have the option to authenticate with your existing profile with one of the following social networks, Facebook, Google or Apple and finally register or log in.
For this purpose, you will find the corresponding icons of the respective providers of the social networks supported by our app on the registration page or login page. Before a connection to the providers is established, you must expressly agree to the process and data transfer described below: Your click on the respective icon opens a new window where you have to log in with your login data for the social network. After you have successfully logged in, the social network will tell you which data (name and e-mail address) will be transmitted to us for authentication as part of the registration or login process. If you have agreed to this data transmission, the fields required by us for registration will be filled with the transmitted data. The information required by us for registration or login is your e-mail address. Only after your explicit consent to the use of the transmitted and required data, your data will be stored by us and used for the purposes stated in this privacy policy. In order to be able to carry out the authentication process for registration and login, your IP address is transmitted to the providers of the social network. We have no influence on the purpose and scope of the data collection and on the further processing of the data by the social network providers. Auth0

We use the external authentication service Auth0 for registration in the app. During registration, name, email, profile picture and ID are transmitted to Auth0.
Auth0: Auth0 Inc (a wholly owned subsidiary of Okta, Inc., 10800 NE 8th Street, Suite 700, Bellevue, WA 98004, USA) and/or the relevant Okta subsidiaries that process personal data on the basis of a data processing agreement. 5. payment and payment service provider

During the ordering process in our online store, you can choose between payment by credit card or payment via SEPA direct debit. Payments are processed via the payment service providers Adyen (Adyen N.V., Simon Carmiggeltstraat 6-50, 1011 DJ Amsterdam, Netherlands), Google Pay (Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, Ireland) or Apple Pay (Apple Distribution International, Hollyhill Industrial Estate, Hollyhill, Cork, Ireland). In this case, your IP address, information about your order such as invoice amount, customer number, your email address and a payment IDs as well as the credit card or account data you entered will be forwarded to the payment service provider for the purpose of further processing the payment transaction. The payment service provider will also transmit this information to other third parties if this is necessary for the payment process (e.g. banking institution, credit card institution). The selected payment service provider is solely responsible for the processing of the payment data that takes place in the course of the subsequent payment transaction. The data collection and transmission is encrypted and we have no access to this information. We therefore also do not store any payment data, but only receive a reference from the payment service provider for payment processing.

The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. b GDPR (fulfillment of a contract).

6. subsidy program

Subsidy programs ("Subsidy Program") allow participating customers to purchase goods at discounted prices from the respective food vending machine. Customers who have been authorized by the respective site operator of the food vending machine (e.g. employer) ("Site Operator") by means of a code provided or by validating an e-mail address assigned by the Site Operator may participate in such a Subsidy Program. Foodji is entitled to pass on the data of all customers participating in a subsidy program to the location operator. This serves to fulfill the obligations of the location operator and the legal requirements for subsidizing employee catering. The data transmitted serves to identify the participating customer and all purchases made via the subsidy program. The customer participating in the subsidy program can also opt out of the subsidy program by contacting Foodji directly.

The legal basis for the transfer of data is Art. 6 para. 1 sentence 1 lit. c GDPR (fulfillment of a legal obligation) and Art. 6 para. 1 sentence 1 lit. b GDPR (execution of a contract / pre-contractual measures).

7. support tools

In our app, we use the support tool Intercom (INTERCOM, INC., 552nd St, 4th Fl., San Francisco, CA 94105 USA). This is a communication platform for direct interaction via chat with the users of the app. If you have any questions, we can use this communication option to provide you with prompt assistance. If you have registered, certain personal data will be collected and passed on at regular intervals. Your details (browser type/version, operating system used, time of server entry, first name, surname, telephone number, email address, company name) are collected in this context when you register on the portal and transmitted to Intercom securely using SSL encryption. Intercom is also used to analyze and evaluate website usage (e.g. usage data. The legal basis for the use of Intercom is our legitimate interest in responding to your request and providing individual support in the use of the website, optimizing the use of our website in terms of user-friendliness and our service in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR. We also use the Front tool (FrontApp Inc., 525 Brannan St. 300, San Francisco, CA 94107, USA) for our customer inquiries and to bundle our support channels. FrontApp channels all customer inquiries in one application and helps us to organize customer inquiries. We also use Front to collect customer feedback in order to improve our support service. The legal basis for the use of Front for the aforementioned purposes is our legitimate interest pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR. If your request is aimed at the conclusion of a contract (e.g. purchase of goods), the legal basis for the processing of the data provided is also the necessity for the provision of (pre)contractual services, in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

8. push messages

When installing the app on your device, you can decide whether you want to receive push messages. To send the push messages, we collect, store and use various personal data that are required to ensure device-specific delivery of the push messages according to the push configuration in the app. The legal basis for the processing of this data is your consent, Art. 6 (1) a) DS-GVO. You can deactivate the push message function at any time by either switching off the push function in the settings of the installed app or by selecting the corresponding app in the settings of your smartphone under "Apps" and configuring the notification function there as desired.

9. newsletters and direct marketing

With our newsletter we inform you about us and our offers. To register for the newsletter, only your e-mail address and your name are required. If you register for the newsletter, your e-mail address will be transmitted to us (or our mail provider) and stored there. After registration, you will receive an e-mail to confirm the registration ("double opt-in"). In this context, we (or our mail provider) process the following data:

- Device data (device name, country code if applicable, language, operating system name and version)

You can revoke your consent to the processing of data for the purpose of sending the newsletter or the evaluation of the associated data at any time. The revocation can be made via a link contained in each newsletter or by sending a separate message to us. In doing so, you will not incur any costs other than the transmission costs according to the prime rates.

We use the e-mail address collected when registering a Foodji account via the Foodji app in accordance with Section 7 (3) UWG for direct advertising for our own and similar products and services. If you no longer wish to receive direct advertising, you can object to the use of your e-mail address at any time. This will not incur any costs other than the transmission costs according to the basic rates. You will find the unsubscribe link at the end of every e-mail. Alternatively, you can send us an email to info@foodji.com. We also analyze the success or failure of our marketing campaigns by analyzing whether our e-mail message was opened and which links were clicked on. The emails are sent on the basis of our legitimate interest in direct marketing in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR and Section 7 para. 3 UWG. The analysis of opening and click rates is based on our legitimate interest in direct marketing and the improvement of our marketing campaigns in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.

We use Brevo (Sendinblue GmbH, Köpenicker Str. 126, 10179 Berlin) as our email service provider for sending emails. Brevo stores the data on a server in Germany, where it is deleted no later than two years after termination of the contractual relationship. You can find Brevo's privacy policy here.

To send emails, we also use HubSpot (Hubspot Inc, 25 First Floor, 2nd Floor Cambridge, MA, USA and Ground Floor, Two Dockland Central Guild Street, Dublin 1, Ireland) as an email delivery service provider. HubSpot also processes data in the USA, among other places. As a guarantee in accordance with Art. 44 ff GDPR, HubSpot has the so-called EU standard contractual clauses and is certified in accordance with the EU-US Data Privacy Framework (DPF). Meta Custom Audience

On our website, we use the "Custom Audiences" product from Facebook (Meta Platforms Inc., 1601 S. California Avenue, Palo Alto, CA, 94304) as part of usage-based online advertising. Essentially, a hash value (checksum) is created from your usage data and transmitted to Facebook for analysis and marketing purposes. This is done either by embedding a Facebook tracking pixel on our website or by providing a customer list containing your name and email address, which you have provided to us via a contact form, for example.
